Welcome to Philadelphia Exotic Rentals. We're thrilled you're here, and we want your experience with our cars to be as memorable as it deserves to be. Before you book, please take a few minutes to read through these Terms of Service ("Terms"). They explain how renting from us works, what we expect from you, and what you can expect from us.

 

These Terms apply to your use of our website (www.philadelphiaexoticrentals.com), our booking process, and our rental services. They work together with our Vehicle Rental Agreement (the contract you sign at pickup), which contains the full legal terms of your rental. If anything in these Terms conflicts with the Vehicle Rental Agreement, the Vehicle Rental Agreement controls.

 

By using our website, making a reservation, or signing the Vehicle Rental Agreement, you agree to these Terms. If you don't agree, please don't proceed with a booking.

1. Who Can Rent

To rent one of our vehicles, you must:

 

  • Be at least 21 years old

  • Hold a valid, unrestricted driver's license issued by a U.S. state or recognized international jurisdiction (no suspensions, revocations, or major restrictions)

  • Carry personal auto insurance that meets our requirements (see Section 5)

  • Provide a valid credit or debit card in your name, with sufficient available funds for the rental rate, security deposit, and any incidental charges

  • Pass our identity verification process at pickup

 

We reserve the right to verify your driving record and license status at any time and to decline or cancel a rental if verification doesn't pass. We may also decline service for any other lawful reason at our discretion.

 

 

2. Booking Your Rental

2.1 How Reservations Work

A reservation is confirmed only when (1) you receive written confirmation from us and (2) your booking deposit has been processed. Until both happen, the vehicle is not held for you.

 

We do our best to deliver the exact vehicle you reserve, but on rare occasions a mechanical issue, prior damage, or other circumstance beyond our control may require us to substitute a comparable vehicle or cancel. If that happens, we'll let you know as soon as possible and refund any prepaid amounts as described in Section 4.

2.2 Booking Deposit

A $500 non-refundable booking deposit is required to secure your reservation. The deposit is applied to your total rental balance when the rental proceeds. If you cancel, no-show, or fail identity verification at pickup, the booking deposit is forfeited.

2.3 Authorized Driver Only

Only the person named as Renter on the Vehicle Rental Agreement may operate the vehicle. We don't permit additional drivers unless they're expressly named in a written addendum signed by both parties. Letting anyone else drive — even briefly — is a serious breach of your agreement, voids any protections, and makes you fully liable for everything that follows.

 

 

3. Pricing and Charges

3.1 What You'll Pay

Your rental quote covers the daily rate, mileage allowance, and any delivery fees we agreed on. Beyond that, you may also be charged for:

 

  • Sales tax as applicable under Pennsylvania law

  • Security deposit: $1500 minimum held at pickup and released after a satisfactory return (subject to your card issuer's posting timelines)

  • Mileage overage at the per-mile rate stated in your Rental Agreement

  • Late return fee: $150 per hour or partial hour past your scheduled return time

  • Refueling fee: actual cost of fuel plus a $100 service fee if the vehicle isn't returned with a full tank of premium 91-octane fuel

  • Cleaning fee: $250 to $1,500 depending on condition (we don't charge for normal use — only for excessive dirt, sand, pet hair, food residue, bodily fluids, or similar)

  • Smoking/vaping reconditioning: minimum $1,000, up to actual reconditioning cost (smoking and vaping are strictly prohibited)

  • Toll, parking, and citation pass-through: actual amount plus $10 administrative fee per item

  • Off-location return fee: at least $90 plus our actual recovery costs if you return the vehicle to a location other than the agreed return point without prior approval

  • Telematics-related fees as described in Section 7

  • Damage, loss, and theft charges as described in your Vehicle Rental Agreement

  • Other charges expressly authorized in your Vehicle Rental Agreement

3.2 Payment Authorization

When you complete your booking and sign our Payment Authorization Form, you authorize us to charge your payment method for all of the charges above, including charges identified after you return the vehicle. We may charge your card on file for damage, diminished value, loss of use, fees, fines, and any other amounts owed under your Vehicle Rental Agreement, in accordance with that agreement.

 

We don't claim that this authorization is "irrevocable" or that it overrides your card-network rights — those rights are protected by federal law and card-network rules, and nothing here changes that. What we do ask is that if you have a billing concern, you contact us first so we can sort it out (see Section 9).

3.3 Security Deposit

We collect a security deposit by hold or charge on your card at pickup. After you return the vehicle and we confirm there are no additional charges, we release the unused portion. Posting timelines after release are controlled by your card issuer and are typically 5–10 business days, but can take longer in some cases. Please keep in mind a rental cancelation due to insufficient funds available for your security deposit is not grounds for a refund or store credit.

 

 

4. Cancellations, Refunds, and Rescheduling

We get it — plans change. Here's how cancellations work, in plain terms:

4.1 If You Cancel

24+ hours before scheduled start: Booking deposit forfeited. Rental balance fully refundable.

 

Within 24 hours of scheduled start: Booking deposit forfeited. No refund of rental balance.

 

No-show (you don't appear at pickup): Booking deposit forfeited. No refund of rental balance.

 

Failed ID verification at pickup (not cured within 24 hours): Booking deposit forfeited. No refund of rental balance.

 

The security deposit, if already collected, is fully refundable in all cancellation scenarios.

4.2 Rescheduling

If you need to reschedule, contact us as soon as possible. At our discretion, we may apply your booking deposit as credit toward a rescheduled rental within 90 days of the original date, subject to vehicle availability. Rescheduling is not guaranteed and depends on availability and circumstances.

4.3 Early Returns

We don't refund early returns. The full rental rate is earned for the term you reserved, since the vehicle is held exclusively for you during that period.

4.4 If We Cancel

If we cancel your reservation due to mechanical issues, prior damage, or other circumstances outside your control, we'll refund all prepaid amounts (including the booking deposit) within 5–10 business days. We're not liable for incidental costs you may have planned around the rental (flights, hotels, events, etc.), and we strongly recommend travel insurance for trips built around a rental.

4.5 Non-Refundable Items

These items are non-refundable once incurred:

 

  • Booking deposit (except as described in Section 4.4)

  • Delivery and pickup fees once service has been provided

  • Processing fees and merchant fees, where applicable

  • Rental fees or daily rates once the trip has started.

  • Charges incurred during the rental (late fees, fuel, tolls, citations, cleaning, damage, etc.)

4.6 Refund Processing

Eligible refunds go back to your original payment method within 5–10 business days. Posting times after that are up to your card issuer or bank, and we can't speed up their internal processing.

 

 

5. Insurance

You must carry your own personal auto insurance with at least:

 

  • $100,000 / $300,000 bodily injury liability (per person / per occurrence)

  • $100,000 property damage liability

  • Comprehensive and collision coverage with a deductible no higher than $1,000

  • Coverage that extends to high-value or exotic rental vehicles (please confirm with your carrier — many standard policies don't automatically cover six-figure vehicles)

 

Your insurance is primary during the rental term. Pennsylvania's Motor Vehicle Financial Responsibility Law (75 Pa. C.S.A. § 1701 et seq.) governs the relationship between rental driver insurance and minimum coverage requirements.

 

We may verify your coverage directly with your carrier and may require you to be named as primary insured for the rental term. If your insurance lapses or is cancelled during the rental, you must notify us immediately.

 

We do not currently offer a Loss Damage Waiver (LDW) or Collision Damage Waiver (CDW). You are fully responsible for damage to or loss of the vehicle, as detailed in your Vehicle Rental Agreement.

 

 

6. How You Can (and Can't) Use the Vehicle

6.1 Where You Can Drive

The vehicle stays in the continental United States. No Mexico, no Canada — even briefly, even with permission from a friend. International operation voids your protections and creates major recovery problems for us.

6.2 Mileage

Each rental includes a daily mileage allowance specified in your Vehicle Rental Agreement. Miles over the allowance are charged at the per-mile rate stated there. We record the odometer at pickup and return.

6.3 What You Can't Do With the Vehicle

These uses are strictly prohibited and will void your protections, terminate your rental, and make you liable for everything that follows:

 

  • Operating impaired — alcohol, marijuana (regardless of state legality), other controlled substances, or impairing medications

  • Letting anyone else drive who isn't named in the Rental Agreement

  • Hire or commercial transport — Uber, Lyft, DoorDash, deliveries, or any for-hire service

  • Racing or track use — racing, contests, time trials, autocross, driving schools, or any closed-course operation

  • Organized driving events — track days, cars-and-coffee meetups, canyon runs, group drives, club events, or similar events without our prior written permission

  • Off-road or unpaved surfaces that aren't intended for ordinary passenger-vehicle use

  • Towing or pushing any other vehicle, trailer, or object

  • Criminal activity — transporting controlled substances, contraband, illegal weapons, or anything that would violate human-trafficking laws

  • Reckless or impaired driving, including overloading the vehicle beyond manufacturer specs

  • Hand-held phone or device use while driving, in violation of applicable law

  • Smoking, vaping, or any combustible/aerosolized substance inside the vehicle (this includes hookah pens, vape pens, cannabis vapes — anything that produces vapor or smoke)

  • Tampering with GPS, OBD-II, or telematics devices

  • Modifications of any kind — temporary wraps, decals, magnetic signs, adhesive-mounted accessories, performance tuning, ECU modifications, or aftermarket parts

  • Commercial or paid content creation — paid photoshoots, music videos, ads, films, brand promotion, or compensated content. Personal social media use is fine, as long as no one is paying you and no commercial sponsor is featured.

6.4 Valet Parking

You're welcome to use valet parking, but if a valet damages the vehicle, you're responsible — not us. We'll look to you for the full damage amount, and you can pursue the valet operator directly. We don't get involved in those claims.

6.5 Fuel

The vehicle leaves with a full tank of premium 91-octane (or higher) fuel and should come back the same way. Regular gasoline, racing fuel, and additives are not allowed. If the tank isn't full at return, we charge actual refill cost plus a $100 service fee.

 

 

7. GPS, Telematics, and Driving Behavior

Every vehicle in our fleet has GPS and OBD-II telematics that record location, speed, acceleration, braking, gear selection, engine RPM, and similar driving data. We use this information to locate vehicles, respond to emergencies, verify compliance with the Rental Agreement, investigate damage or mechanical failures, assist law enforcement when required, and protect our legal rights.

7.1 Driving Behavior Limits

The following will result in consequences:

 

  • Tampering with, removing, or disabling any tracking or telematics device

  • Tampering with, removing, or impeding vehicle cameras

  • Exceeding speeds greater than 90 mph

  • Repeated hard acceleration or hard braking

 

You get one (1) total warning across all categories. After that warning, any further violation — regardless of category — results in forfeiture of your security deposit and early termination of your rental, with repossession at our discretion and your expense.

7.2 Speeds Over 100 mph

If telematics records a speed of 100 mph or higher, you'll be charged up to $500 per occurrence based on our reasonable estimate of accelerated wear, increased insurance exposure, and inspection costs. You're also responsible for a full mechanical and safety inspection and any resulting repairs. The $500 cap applies only to the per-occurrence fee — actual damage from such operation is governed by the damage liability section of your Vehicle Rental Agreement.

 

 

8. Damage, Loss, and Theft

You're responsible for the vehicle from pickup to return — full stop. We don't include LDW or CDW in our rates, and you're liable for all damage regardless of fault, except as limited by Pennsylvania law.

 

This includes:

 

  • All cosmetic damage — chips, scratches, curb rash, wheel damage, tire damage, windshield damage, interior damage, and undercarriage damage. There's no wear allowance.

  • Repair costs at OEM and certified-specialty rates appropriate to the make and model

  • Total loss — pre-loss fair market value (less salvage) if the vehicle can't be repaired, or the loan balance if greater

  • Diminished value — the loss in resale value following structural, paint, or significant cosmetic repair, calculated by an independent licensed appraiser using a recognized methodology (such as the 17c formula)

  • Loss of use — 70% of the daily rental rate for up to 30 days while the vehicle is out of service

  • Incidental losses — towing, storage, recovery, appraisal, and reasonable administrative costs

 

We may charge your card on file for damage discovered within 30 days after return, and we reserve our right to pursue claims for damage discovered later within the applicable statute of limitations.

 

If damage occurs, you must notify us within four (4) hours (or as soon as reasonably possible), file a police report where required, and cooperate fully with our investigation and any insurance claim. The full damage and insurance cooperation provisions are in Section 16 of your Vehicle Rental Agreement.

 

 

9. If You Have a Billing Concern

If something on your bill doesn't look right, please contact us first — before disputing the charge with your card issuer. Most billing questions are easily resolved with a quick conversation, and we're committed to working with you in good faith.

We ask that you give us 30 days to investigate and respond before initiating a chargeback. Filing a chargeback without first raising the issue with us is a breach of your Vehicle Rental Agreement and may result in collection action, including reasonable attorneys' fees and a 1.5% monthly finance charge on past-due amounts as permitted by Pennsylvania law.

 

We won't pretend you can't dispute charges with your card issuer — federal law and card-network rules give you that right, and nothing here takes it away. But the fastest, easiest, and best path for everyone is to call us first.

 

 

10. Cameras in the Vehicle

Our vehicles are equipped with dashboard-facing and interior cabin-facing cameras. The cameras do not record audio. They're there to protect the vehicle, monitor for unauthorized drivers, verify compliance with the Rental Agreement, and document the condition of the vehicle during the rental.

 

Camera footage is retained for up to 24 hours after rental return and then automatically overwritten, except in cases of accident, suspected damage, contract violation, insurance claim, or law-enforcement request, where we may retain it longer. You'll be notified if footage is retained beyond 24 hours.

 

While operating or occupying the vehicle, you have no expectation of privacy in areas the cameras can see. Tampering with or disabling a camera is a material breach and results in immediate repossession and forfeiture of your full security deposit.

 

 

11. Repossession

If you breach the Rental Agreement, fail to return the vehicle on time, or trigger telematics-based termination, you authorize us (and our agents and recovery services) to repossess the vehicle without legal process, as long as we don't breach the peace doing so. You'll be responsible for the costs of repossession — towing, storage, locksmith, and recovery-agent fees.

 

This authorization is part of why we're able to keep our rates competitive on these vehicles. We rarely have to use it, but we have to be able to recover our property quickly when something goes wrong.

 

12. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to your rental will not exceed the total rental fees you paid for the rental in question. We're not liable for incidental, special, indirect, or consequential damages — things like lost wages, missed events, or trip cancellation costs. We're not responsible for personal property left in or on the vehicle.

 

These limitations apply even if a remedy fails of its essential purpose, except where prohibited by law.

 

 

13. Indemnification

You agree to defend, indemnify, and hold harmless Philadelphia Exotic Rentals LLC and its members, managers, officers, employees, agents, and affiliated entities from any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of:

 

  • Your use of the vehicle

  • Your breach of these Terms or the Vehicle Rental Agreement

  • The acts or omissions of any person operating or occupying the vehicle during your rental

  • Any claim brought by a passenger or other occupant of the vehicle

 

You represent that you'll inform passengers that the vehicle is rented and that riding in a high-performance vehicle carries inherent risks.

 

 

14. Dispute Resolution and Arbitration

 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR PARTICIPATE IN A CLASS ACTION.

14.1 Talk to Us First

Most disputes get resolved with a phone call. Before filing anything formal, please send us a written notice describing the issue and what you'd like us to do about it. We'll have 30 days to work it out informally.

14.2 Binding Arbitration

If we can't resolve the dispute in those 30 days, any controversy or claim arising out of or relating to these Terms, your rental, or the vehicle — whether based in contract, tort, statute, or otherwise — will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Philadelphia, Pennsylvania, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

14.3 Class Action Waiver

You and we both agree to bring claims only individually — not as a class plaintiff, class member, or representative. The arbitrator can't consolidate multiple parties' claims and can't preside over any class or representative proceeding.

14.4 Exceptions

Either of us can still:

 

  • Bring an individual claim in small-claims court if it qualifies

  • Seek injunctive or equitable relief in court to protect intellectual property or recover the vehicle

  • We can also pursue collection actions in court for unpaid amounts

14.5 30-Day Opt-Out

You can opt out of the arbitration provisions in this Section 14 by sending us written notice within 30 days of signing your Vehicle Rental Agreement. The notice should include your name, address, and a clear statement that you're opting out. Opting out doesn't affect any other part of these Terms.

14.6 Court Venue for Anything Else

For any claim that isn't subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts in Philadelphia County, Pennsylvania.

 

 

15. Pennsylvania Disclosures

Theft of Services. Failure to return rental property when the rental term ends, or failure to pay all amounts due (including damage charges), may constitute a violation of Pennsylvania law and is subject to civil and criminal penalties under 18 Pa. C.S.A. § 3926.

 

Insurance Primacy. Under Pennsylvania's Motor Vehicle Financial Responsibility Law (75 Pa. C.S.A. § 1701 et seq.), the renter's valid and collectible liability insurance is primary for the limits required by 75 Pa. C.S.A. § 1786. PIP benefits may be available in accordance with the MVFRL.

 

 

16. Website Use and Privacy

These Terms also apply to your use of our website at www.philadelphiaexoticrentals.com.

16.1 Acceptable Use

You may browse our website for personal, non-commercial purposes. You may not:

 

  • Scrape, copy, or republish our content (vehicle photos, descriptions, pricing, or written content) without permission

  • Attempt to access non-public parts of our site, security tools, or other systems

  • Use automated tools to interact with our site beyond normal browsing

  • Submit fraudulent inquiries or bookings

  • Impersonate another person or entity

16.2 Intellectual Property

All content on our website — including logos, photos of our vehicles, written descriptions, marketing materials, and the site design itself — is owned by or licensed to Philadelphia Exotic Rentals LLC and protected by copyright and trademark law. You may not use any of it without our prior written consent.

16.3 Information We Collect

When you use our website or book with us, we collect information including:

 

  • Information you provide — name, contact info, license details, payment information, insurance details, and other booking-related details

  • Verification materials — ID photos, verification photographs, and signed receipts collected at pickup (see Section 17)

  • Telematics data — location, speed, acceleration, braking, RPM, and gear selection during the rental

  • Camera footage — as described in Section 10

  • Website analytics — IP address, device type, browser, pages viewed, referring site, and similar data, typically through cookies and analytics tools

16.4 How We Use It

We use this information to:

 

  • Process bookings and rentals

  • Verify identity and prevent fraud

  • Communicate with you about your rental

  • Comply with legal and contractual obligations

  • Defend our legal rights, including in chargeback disputes

  • Improve our website and services

16.5 Who We Share It With

We don't sell your personal information. We share information with:

 

  • Payment processors (Stripe and similar) to process transactions

  • Insurance carriers and benefit providers in the event of a claim

  • Card networks (Visa, Mastercard, American Express, Discover) and processors as compelling evidence in chargeback disputes

  • Law enforcement when required by law or in response to lawful process

  • Our attorneys, auditors, and other professional advisors as needed

  • Recovery and collections agents if you owe us money or fail to return the vehicle

  • Service providers who help us run our business (IT, hosting, telematics, etc.) under appropriate confidentiality terms

16.6 Cookies

We use cookies and similar technologies to operate the website, remember your preferences, and analyze traffic. You can disable cookies through your browser, but some features may not work properly without them.

16.7 Data Retention

We retain your information as long as necessary for the purposes above and to comply with legal obligations. After that, we delete or anonymize it. Camera footage retention is described in Section 10. Telematics and rental records are typically retained for the longer of seven years or the applicable statute of limitations period.

16.8 Your Rights

Depending on where you live, you may have rights to access, correct, delete, or object to certain processing of your personal information. To exercise these rights, contact us using the information in Section 19.

16.9 Children

Our services are not directed at anyone under 21, and we don't knowingly collect information from minors. If you believe we have collected information from a minor in error, please contact us.

16.10 Changes to Privacy Practices

If we make material changes to how we handle personal information, we'll update this section and post the new effective date.

 

 

17. Identity Verification at Pickup

To protect both of us against fraud, we require the following at pickup:

 

  • Original driver's license for in-person inspection and photographic copy

  • A second form of government-issued photo ID (passport, state ID, or military ID)

  • The physical credit or debit card on file, photographed (front, last four digits visible) while you hold it

  • A photograph of you holding your driver's license next to your face

  • A signed pickup receipt confirming acceptance of the vehicle and authorization of the charges

 

By making a reservation and signing the Vehicle Rental Agreement, you consent to providing these materials and authorize us to use them for fraud prevention, identity verification, and as compelling evidence in any chargeback or dispute. If you can't or won't provide them at pickup, we may decline to release the vehicle, and the booking deposit is forfeited.

 

 

18. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control — natural disasters, severe weather, fires, mechanical failures (other than caused by Renter), governmental actions, civil unrest, pandemics, and supply-chain disruptions. If we can't deliver your vehicle because of one of these events, our only obligation is to refund prepaid amounts (less the booking deposit if applicable) for the affected portion of the rental.

 

 

19. General Provisions

19.1 Modifications

We may update these Terms from time to time. The current version will always be posted at www.philadelphiaexoticrentals.com/tos with an updated "Last Updated" date. For reservations already confirmed, the Terms in effect at the time of booking apply. Continued use of our website or services after an update means you accept the updated Terms.

19.2 Conflict with Rental Agreement

If anything in these Terms conflicts with the Vehicle Rental Agreement, the Vehicle Rental Agreement controls for matters relating to the rental itself. These Terms control for website use and pre-booking matters not addressed in the Rental Agreement.

19.3 Severability

If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be reformed to the minimum extent needed to make it enforceable while preserving the original intent.

19.4 No Waiver

If we don't enforce a particular provision on one occasion, that doesn't mean we waive the right to enforce it later.

19.5 Assignment

You may not assign your rights or obligations under these Terms or the Rental Agreement without our prior written consent. We may assign ours without restriction.

19.6 Entire Agreement

These Terms, together with the Vehicle Rental Agreement, the Payment Authorization, the Camera Disclosure, and any other addenda we both sign, are the entire agreement between us regarding your rental and supersede any prior agreements or understandings.

19.7 Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles. The Federal Arbitration Act governs Section 14.

19.8 Electronic Signatures

These Terms and the Rental Agreement may be signed and delivered electronically. Electronic signatures have the same effect as handwritten signatures under the federal E-SIGN Act and the Pennsylvania Uniform Electronic Transactions Act.
