Please read these Terms of Service ('Terms') carefully before renting a vehicle from Philadelphia Exotic Rentals LLC ('Company,' 'we,' 'us,' or 'our'). By booking a vehicle through our website, phone, or any third-party platform, or by signing our Rental Agreement, you ('Renter,' 'you,' or 'your') agree to be bound by these Terms in their entirety.

These Terms are incorporated into and form part of your Rental Agreement. In the event of any conflict, the Rental Agreement shall control.

1. ACCEPTANCE OF TERMS

By completing a reservation, making a payment, or taking possession of a vehicle, you acknowledge that you have read, understood, and agreed to these Terms, our Rental Agreement, and our Payment Authorization Form. If you do not agree, you must not proceed with the rental.

Acceptance of these Terms also constitutes your express authorization for Philadelphia Exotic Rentals LLC to charge your payment method on file for all amounts due under the Rental Agreement, including but not limited to rental fees, security deposits, late fees, damage charges, cleaning fees, fuel fees, tolls, and any other applicable charges.

2. RESERVATIONS & BOOKING

2.1 Reservation Confirmation

A reservation is not confirmed until you receive written confirmation from Philadelphia Exotic Rentals LLC and a deposit or full payment has been processed. We reserve the right to decline any reservation at our sole discretion.

2.2 Renter Eligibility

To rent a vehicle, you must:

Be at least 25 years of age (age requirements may vary by vehicle)
Hold a valid, non-suspended driver's license issued by a U.S. state or territory
Provide proof of personal auto insurance coverage acceptable to the Company
Present a valid credit or debit card in your name
Pass identity verification at the Company's discretion

We reserve the right to verify your driving record and license status at any time. We may refuse service based on driving history, license validity, or any other factor deemed relevant.

2.3 Authorized Drivers

Only the person named as Renter on the Rental Agreement is authorized to operate the vehicle. No other person may drive the vehicle under any circumstances. Allowing an unauthorized driver to operate the vehicle constitutes a material breach of your Rental Agreement and voids all protections.

3. PAYMENT TERMS

3.1 Charges

The following fees may apply to your rental:

Daily rental rate as quoted at booking
Security deposit (held at commencement of rental, released upon satisfactory return)
Sales tax as applicable under Pennsylvania law
Delivery and pickup fees (where applicable)
Mileage overage charges (see Section 5)
Late return fees of $250 per hour or partial hour beyond the scheduled return time
Cleaning fees of $250–$1,500 depending on condition
Fuel surcharge: cost of fuel plus $100 convenience fee if vehicle not returned full
Toll and parking charges plus $10 administrative fee per occurrence
Smoking/vaping reconditioning fee: minimum $1,000
Unauthorized location return fee: minimum $90
Speeding surcharge: $1,500 per infraction over 110 MPH plus mandatory full vehicle inspection
Damage, loss, or theft charges as outlined in the Rental Agreement

3.2 Payment Authorization

By completing your rental, you expressly authorize Philadelphia Exotic Rentals LLC to charge your payment method on file for all charges listed in Section 3.1, whether incurred at the time of rental or identified following the return of the vehicle. Post-rental charges may be applied up to 60 days after your return date.

You acknowledge that signing the Payment Authorization Form creates a binding, irrevocable authorization for all rental-related charges. Initiating a chargeback or payment dispute for validly authorized charges constitutes a breach of this agreement and may result in collection action.

3.3 Security Deposit

A security deposit will be collected via credit or debit card hold at the commencement of your rental. The deposit will be released upon the satisfactory return of the vehicle and confirmation that no additional charges apply. Release timing is subject to your card issuer's policies and may take 5–10 business days.

4. CANCELLATION & REFUND POLICY

4.1 Renter-Initiated Cancellations

More than 72 hours before rental start: No refund. The full rental fee is forfeited. Security deposits will be fully refunded.

48–72 hours before rental start: No refund. The full rental fee is forfeited. Security deposits will be fully refunded.

Less than 48 hours before rental start: No refund. The full rental fee is forfeited. Security deposits will be fully refunded.

No-shows: No refund. The full rental fee is forfeited.

4.2 Company-Initiated Cancellations

If Philadelphia Exotic Rentals LLC cancels your reservation due to mechanical failure, unforeseen circumstances, or any reason outside your control, you will receive a full refund of all prepaid amounts within 5–10 business days. We are not liable for any incidental or consequential damages arising from a Company-initiated cancellation.

4.3 Early Returns

No refund is provided for early returns. The rental rate is fully earned for the reserved term as stated in the Rental Agreement.

4.4 Non-Refundable Reservation Deposits

All deposits collected to secure a future reservation are strictly non-refundable, regardless of the reason for cancellation. By paying a reservation deposit, you acknowledge and agree that the deposit is earned by Philadelphia Exotic Rentals LLC upon receipt and will not be returned under any circumstances, including but not limited to cancellations, schedule changes, personal emergencies, or dissatisfaction with vehicle availability. Reservation deposits may, at the Company's sole discretion, be applied as a credit toward a rescheduled rental within 90 days of the original reservation date.

4.5 Non-Refundable Items

The following are non-refundable under all circumstances:

Reservation deposits (see Section 4.4)
Delivery and pickup fees once service has been rendered
Processing fees
Any additional charges incurred during the rental period (late fees, fuel, tolls, cleaning, damages, etc.)

4.6 Refund Processing

All eligible refunds will be returned to the original payment method within 5–10 business days. Philadelphia Exotic Rentals LLC is not responsible for delays caused by your card issuer or financial institution.

5. VEHICLE USE & RESTRICTIONS

5.1 Mileage

Each rental includes a specified mileage allowance as stated in your Rental Agreement. Miles driven in excess of the allowance will be charged at the per-mile overage rate stated in your agreement. Odometer readings are recorded at pickup and return.

5.2 Geographic Restrictions

Vehicles may not be driven outside the contiguous United States without prior written authorization from Philadelphia Exotic Rentals LLC. Operation in Mexico is strictly prohibited unless expressly approved in writing.

5.3 Prohibited Uses

The following uses are strictly prohibited and constitute a material breach of your Rental Agreement:

Operating the vehicle while under the influence of alcohol, drugs, or impairing medications
Allowing any unauthorized driver to operate the vehicle
Using the vehicle for hire, rideshare, or delivery services (e.g., Uber, Lyft, DoorDash)
Racing, track events, contests, or off-road operation
Towing or pushing any object
Transporting illegal substances, contraband, or engaging in any criminal activity
Smoking, vaping, or using tobacco products of any kind inside the vehicle
Removing, tampering with, or obstructing the vehicle's GPS/OBD2 tracking device
Operating the vehicle at speeds exceeding 110 MPH
Using a handheld wireless device while operating the vehicle

5.4 Fuel Requirements

All vehicles must be returned with a full tank of Premium fuel (91 Octane minimum). Racing fuel and additives are prohibited. Failure to return the vehicle with a full tank will result in a fuel charge at current market rates plus a $100 convenience fee.

6. VEHICLE CONDITION & DAMAGE

You accept the vehicle in the condition noted at pickup and are responsible for returning it in the same condition. You are liable for all damage, loss, or theft occurring during your rental period regardless of fault. Philadelphia Exotic Rentals LLC may assess damage charges up to 60 days following your return date.

You may not authorize or undertake repairs to the vehicle without the Company's prior written consent. Loss of use fees apply while the vehicle is out of service for repairs.

7. GPS TRACKING

All vehicles are equipped with GPS and OBD2 tracking devices. By renting with us, you consent to the use of these devices to monitor vehicle location, speed, acceleration, braking, and other operational data throughout the rental period. This data may be used to enforce the terms of your Rental Agreement, assess fees, recover the vehicle, or provide evidence in disputes.

Removal, obstruction, or tampering with any tracking device will result in immediate forfeiture of your security deposit and termination of your rental.

8. DISPUTES & CHARGEBACKS

You acknowledge that all charges applied to your payment method by Philadelphia Exotic Rentals LLC are authorized pursuant to your Rental Agreement and Payment Authorization Form. Prior to initiating any dispute or chargeback with your card issuer, you agree to contact Philadelphia Exotic Rentals LLC directly at (267) 473-9249 or via email to resolve the matter.

Initiating a chargeback for charges that are valid under these Terms and your Rental Agreement constitutes a breach of contract. Philadelphia Exotic Rentals LLC reserves the right to pursue collection of all amounts owed, including collection costs, attorney's fees, and a 1.5% monthly late charge on outstanding balances, as permitted by Pennsylvania law. Fraudulent disputes may be reported to appropriate authorities.

9. LIMITATION OF LIABILITY

Philadelphia Exotic Rentals LLC's liability to you for any claim arising out of or related to your rental shall not exceed the total rental fees paid by you for the applicable rental period. We are not liable for incidental, special, or consequential damages of any kind. We are not responsible for loss of or damage to personal property left in or on the vehicle.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Philadelphia Exotic Rentals LLC, its members, managers, employees, agents, and affiliates from all claims, liabilities, losses, damages, costs, and expenses (including attorney's fees) arising from your use of the vehicle, your breach of these Terms or the Rental Agreement, or any acts or omissions by you or any person operating or riding in the vehicle.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any dispute arising out of or related to these Terms or your rental shall be subject to the exclusive jurisdiction of the courts of Pennsylvania.

You agree that any dispute must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. MODIFICATIONS TO TERMS

Philadelphia Exotic Rentals LLC reserves the right to update or modify these Terms at any time. Updated Terms will be posted at www.philadelphiaexoticrentals.com. Your continued use of our services following any update constitutes acceptance of the revised Terms. For rentals already confirmed, the Terms in effect at the time of booking apply.
